During her career Karen has gained extensive experience in all aspects of family law, from complex property settlements and children’s issues to acting for women in domestic violence applications. Her experience in the field of domestic violence also led her to be one of the initial solicitors involved in the advocacy service established at Parramatta Court in the early 1990s to represent victims of violence in AVO applications.Karen is also trained in the new collaborative family law approach to separation and is a member of the Greater Sydney Collaborative Family Lawyers group.

She works with clients to understand their individual situation, their needs and their expectations and then strives to achieve the best possible outcome for her client in all cases. In her day-to-day dealings with clients, Karen’s down to earth and approachable style is welcomed by all.

Separation and Divorce

Separation does not necessarily lead to divorce but for couples who have been separated for 12 months and feel that the marriage has broken down irretrievably, divorce is an option. We can help you through this difficult period by providing professional advice and guidance, and ultimately minimising the impact on you and your family. We have the skills, experience and training to offer two different approaches to divorce, depending upon your individual circumstances and situation:i. The new collaborative family law approach that resolves issues surrounding your separation and divorce through face-to-face negotiation and avoids the need to go to court;ii. The more traditional approach in which we can negotiate with lawyers acting on behalf of your ex-spouse and, where necessary, successfully represent you in Family Court. It is important to note that the majority of separations do not end up in Court and we will make every effort to avoid litigation.

Children’s Issues and Parenting Arrangements

Whenever children are involved in a family breakdown it is essential that their best interests are kept at the forefront of any decision-making exercise.Separation is an extremely difficult time for children and we aim to minimise the impact of the process on them, and keep their rights in mind, whether we are negotiating custody, access, child support or visitation rights. Our principal, Karen Haga, was one of the first solicitors appointed by the Legal Aid Commission to represent children in Court and she has significant experience in this particular area.Importantly, in the majority of cases, we can assist our clients to resolve any issues regarding children without the intervention of the Court. Any agreements can then be made binding in the form of Parenting Orders.

Property Settlements

A property settlement is one of the most important features of a separation/divorce in that it sets out how the assets of the relationship will be divided. Couples do not need to be formally divorced before reaching agreement on a property settlement, and de-facto couples can also reach a formal settlement under different legislation.Property settlements are important because they are legally binding and clearly stipulate how the assets are to be split. Having a legally binding settlement reduces the risk of future disputes and uncertainty. At Karen L Haga & Associates we can work with you to reach an agreement with your spouse, and then have the agreement formalised (either as Court Orders or a Binding Financial Agreement depending upon the circumstances).

De-facto Relationships

In 2009, the way in which a de-facto relationship breakdown was dealt with under legislation changed.Prior to that date, property settlement issues for couples who lived together  were considered under the relevant State-based legislation.  However, since 1st March 2009 all de-facto relationship disputes are now dealt with under the Commonwealth Family Law Act.  This means that de facto couples, and same -sex couples, who are involved in property or parenting disputes are now subject to the same legislation as a married couple. At Karen Haga & Associates our experienced lawyers can help you to negotiate an agreement with your former partner in relation to property or parenting disputes post separation, and provide e
